Definitions 

The ‘Hirer’ or ‘Hirers’ refers to: ‘The Client and any associated persons present on the day/s of hire’. ‘Studio Hire’ refers to: ‘The rental and use of the Kimura Performance Podcast Studio premises for a contractually specified time and date for the business of photography, filming or event related hire’. ‘The Client’ means: ‘The individual, group of individuals or entity which have entered into this hire agreement with Kimura Performance Podcast Studio. The ‘Kimura Performance Podcast Studio Online Booking System’ – Is the combined booking and payment interface on the studio website.   

Booking 

All bookings must be confirmed by the Hirer, via the Kimura Performance Podcast Online Booking System, prior to the studio rental taking place. Confirmation of the booking will be provided by email upon payment, only completed entries onto the Kimura Performance Podcast Studio Online Booking System will guarantee availability for the agreed period. 

Cancellations 

Cancellations of confirmed bookings made within 48hrs of the 1st or only specified shoot date, will be subject to 100% of the studio hire rate plus all costs incurred by Kimura Performance Podcast Studio. Confirmed bookings cancelled before this time will be subject to 50% of the studio hire rate. 

Lighting & Equipment 

The following lighting and equipment is provided by Kimura Performance Podcast Studio as part of the standard studio hire package:

Any branding or imagery to be displayed on the studio screens by the Hirer and colours required for the studio LED lighting to be provided to Kimura Performance Podcast Studio no less than 24 hours prior to the shoot.  

Rates and Charges 

Rates for the Studio Hire are set out on the Kimura Performance Podcast Studio Online Booking System.  All bookings shall include a Sound Engineer as part of the standard package.  The hire of a Video Operator will be charged in addition to the standard package.  

Hourly Rate Charges 

9am to 6pm

9am to 1pm or 2pm to 6pm

Payment Terms 

The Hirer must make payment in full for the service they require prior to the hire of the studio is made via the Kimura Performance Podcast Studio Online Booking system.  

Damages and Cleaning 

The Hirer is placed on notice that the Studio is monitored by CCTV.  The Hirer will be liable for any damage made to the fabric of the building, fixtures, fittings, furniture or appliances therein or equipment hired throughout the duration of the booking, unless a member of Kimura Performance Podcast Studio’s staff causes such damage. The value of charges for damage will be set to cover the bb full cost of repair or replacement of such items as appropriate. General cleaning charges are included in the studio hire charge however should specialist cleaning or repainting be required of any areas further charges may apply. Clients are requested to ensure that they have suitable public liability insurance, as they will not be covered under the studio insurance. Clients are responsible for insurance of all items that they bring into the building. No alterations, decorations or additions to the space are permitted without the written consent of Kimura Performance Podcast Studio. The client must notify the Studio at the time of supply if the condition of any equipment that is not acceptable. 

Personal Property and Equipment 

Kimura Performance Podcast Studio will not be held responsible for loss or damage to any equipment or personal property of the Hirer. No Hirer property will be covered by any insurance held by Kimura Performance Podcast Studio. Any items left on the premises are left at the Hirer’s own risk. 

Deliveries and Collections 

Kimura Performance Podcast Studio do not accept deliveries and collections of the Hirer’s property.  

Catering and Refreshments 

Kimura Performance Podcast Studio can provide catering facilities and refreshments in the communal breakout area located on the same floor as the studio.  

Insurance and Liability 

The use of Kimura Performance Podcast Studio’s equipment is entirely at the Hirer’s risk. Kimura Performance Podcast Studio will not be held liable for any consequential damage, injury or loss to the hirer, their part or possessions whilst using our premises. Kimura Performance Podcast Studio cannot accept liability for loss or damage, (including loss of earnings) incurred to the Hirer by circumstances that are out of reasonable control of Kimura Performance Podcast Studio, including (but not limited to) power cuts, fire, flood, Acts of God, war, civil disturbance or industrial action.

Hirer/User Content 

The Hirer is solely responsible for their Content and the consequences of posting or publishing it. The Hirer represents and warrants that: (1) they are the creator or own or control all right in and to the Content or otherwise have sufficient rights and authority to grant the rights granted herein; (2) their Content does not and will not: (a) infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right, or (b) defame any other person; (3) their Content does not contain any viruses, adware, spyware, worms, or other harmful or malicious code; and (4) unless you have received prior written authorization, their Content specifically does not contain any pre-release or non-public beta software or game content or any confidential information of Kimura Performance Podcast Studio or third parties. Kimura Performance Podcast Studio reserves all rights and remedies against any hirers who breach these representations and warranties. 

Prohibited Conduct 

The Hirer AGREES NOT TO violate any law, contract, intellectual property, or other third-party right; not to commit a tort, and that you are solely responsible for your conduct in using Kimura Performance Podcast Studio’s facilities. 

The Hirer agrees that they will comply with Kimura Performance Podcast Studio’s Terms of Service and will not: 

1. create, upload, transmit, distribute, or store any content that is inaccurate, unlawful, infringing, defamatory, obscene, pornographic, invasive of privacy or publicity rights, harassing, threatening, abusive, inflammatory, or otherwise objectionable; 

1. impersonate any person or entity; falsely claim an affiliation with any person or entity; 

1. defame, harass, abuse, threaten, or defraud anyone; 

1. use Kimura Performance Podcast Studio’s services for any illegal purpose, or in violation of any UK, or international law or regulation, including without limitation laws governing intellectual property and other proprietary rights, data protection, and privacy. 

Kimura Performance Podcast Studio is not liable for any statements or representations included in User Content. Kimura Performance Podcast Studio does not endorse any Hirer/User Content, opinion, recommendation, or advice expressed therein, and Kimura Performance Podcast Studio expressly disclaims any and all liability in connection with User Content. To the fullest extent permitted by applicable law, Kimura Performance Podcast Studio reserves the right to request to terminate the studio hire of any hirer who breaches its User Content Conditions.
